Divorce Basics in Ohio

Ohio law allows for both no-fault and fault-based divorce. In a no-fault divorce, you do not have to prove any “grounds” other than that the marriage is irreparably broken. You may also apply for a no-fault divorce if you and your spouse have lived separate and apart for at least a year.

Possible grounds for fault-based divorce include:

  • Bigamy
  • Adultery
  • Extreme cruelty
  • Willful absence for at least a year
  • The marriage was based on a fraud
  • Gross neglect of duty
  • Habitual drunkenness
  • Spouse imprisonment

We Are Here to Advocate for Your Best Interests

In any divorce, regardless of fault, you will have to make many tough decisions regarding child custody, child support, property division, and alimony. You and your spouse may come to an agreement about these issues on your own or through mediation. If you cannot agree, however, you will need to present your case to the court for a decision.

At such an emotional time, you can rely on our Dayton family lawyers to provide the guidance needed throughout the entire legal process. You will have at your disposal a team of trial-tested litigators with an abundance of knowledge, skills, and resources. Divorce is never simple, but our firm can work on your behalf to help make it a less stressful experience.
